New Inheritance Wills for Dubai Property Owners To Come In
11 Apr 2015
A new real estate Landmark ruling regarding wills for expats will have a major effect on the risks of owning Dubai real estate for non Muslims.
The long awaited move means that expats can now register their wills and with regard to succession and inheritance rights on Dubai freehold property. The new rules will mean that the wills can now be logged with the DIFC which is the Dubai International Financial Centre and be valid in Dubai. Previously successors who were non Muslim had to oppose Sharia law which meant that the deceased assets could follow the male bloodline even for non Muslims and not follow the wishes of the deceased. The wills will also cover moveable assets including bank funds , personal possessions etc , the wills will have to be written by an authorized registrar who must be registered within the DIFC community as any mistake could jeopardize the legality of the will .
Wills prepared by unqualified writers can mean that you died intestate ( without a will ) and therefore risk lengthy disputes between heirs. This is a major development and seen as a modernization and acknowledgement of the rights of expat owners in Dubai. The first of the wills is expected to be registered over the next few weeks .
